1. Definitions
Company: Refers to Severius Adventures and Travel.
Client: Refers to the individual(s) making a booking and all persons included in that booking.
Tour/Package: The travel arrangements, services, and activities booked through the Company.
Website: The Severius Adventures and Travel website at severiusadventuresandtravel.com.
2. Booking and Confirmation
Process: All bookings are subject to availability. To book, you must complete our booking form and provide accurate information.
Deposit: A non-refundable deposit of [e.g., 30%] of the total tour price is required to secure your booking. This deposit confirms your acceptance of these Terms and Conditions.
Final Payment: The remaining balance must be paid in full no later than [e.g., 45] days before the start of your tour. If the final payment is not received by the due date, we reserve the right to cancel your booking and retain the deposit. 3. Pricing and Inclusions
Currency: All prices on our website and in our communications are quoted in United States Dollars (USD).
Price Inclusions: Prices generally include accommodations, meals as specified in the itinerary, transportation, guide services, and park entrance fees.
Price Exclusions: Prices do not include international flights, visa fees, travel insurance, optional activities, personal expenses (e.g., laundry, souvenirs), and gratuities.
4. Cancellations and Refunds
Cancellation by the Client: All cancellations must be submitted in writing. The following cancellation fees apply:
More than 60 days before departure: Forfeit of deposit.
31-60 days before departure: 50% of the total tour price.
30 days or less before departure: 100% of the total tour price.
Cancellation by the Company: We reserve the right to cancel a tour due to reasons beyond our control, such as political instability, natural disasters, or insufficient bookings. In such cases, we will offer a full refund of all payments made to us or an alternative tour of a similar standard.
5. Changes to Bookings
Changes by the Client: We will make reasonable efforts to accommodate changes to your booking after confirmation, but this is not guaranteed and may incur an administrative fee of [e.g., $50] per change, plus any additional costs charged by third-party suppliers.
Changes by the Company: While we strive to follow the original itinerary, we may need to make minor changes due to unforeseen circumstances. We will inform you of any significant changes as soon as possible.
6. Client Responsibilities
Travel Documents: It is the client’s sole responsibility to possess a valid passport, visas, and any required health certificates. We are not liable for any costs or losses incurred due to a client’s failure to have the correct documents.
Health and Fitness: You must inform us of any medical conditions or physical limitations that may affect your ability to participate in a tour. You are responsible for ensuring you are medically fit for your chosen trip.
Code of Conduct: You must abide by all local laws and follow the instructions of our guides and staff. We reserve the right to terminate your participation in a tour without a refund if your behavior poses a risk to yourself, others, or the wildlife.
7. Travel Insurance We strongly recommend that all clients purchase comprehensive travel insurance at the time of booking. This insurance should cover trip cancellation, medical emergencies, evacuation, baggage loss, and other unforeseen events. We do not provide travel insurance, and our liability is limited to the extent permitted by law.
8. Limitation of Liability Severius Adventures and Travel acts as an agent for various third-party suppliers (e.g., airlines, hotels, and safari operators). We are not liable for any acts, omissions, or negligence of these suppliers. Our liability is limited to the amount paid to us for the tour. We are not responsible for any personal injury, property damage, loss, delay, or expense resulting from events beyond our control, including acts of God, war, terrorism, or natural disasters.
9. Governing Law These Terms and Conditions shall be governed by and construed in accordance with the laws of Kenya. Any legal actions or proceedings arising from these terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
